Terms

The rules of the floor

By registering, bidding or buying you agree to these terms. They are the same for everyone in the room.

01The agreement

These Terms form a binding agreement between you and us. Where a specific lot lists additional conditions of sale, those conditions apply on top of these Terms. Where the two conflict, the lot conditions control — for that lot only.

02Your account

You must be at least eighteen and legally able to enter contracts. Registration details must be accurate and kept current, and you are responsible for everything done under your account.

Tell us at office@circle365.com if you suspect unauthorised access. We may suspend or close accounts that break these Terms, leave invoices unpaid, or that we reasonably believe present a fraud risk.

03Bidding rules

  • Every bid is a binding offer to purchase the lot at that amount.
  • Bids move in fixed increments (default $100). The minimum next bid is the current bid plus one increment.
  • You may set a proxy maximum. The system bids for you in increments and never goes past it.
  • Buy Now, where shown, ends the lot immediately on a confirmed click.
  • A bid inside the final 30 seconds extends the lot by 60 seconds.
  • The highest bid at gavel-fall wins, provided it meets the reserve.
  • If the reserve is not met, the lot does not sell and nothing is owed.

04Title and risk

Title transfers when payment clears in full, and risk of loss transfers at the same moment. Storage is free for three days after payment; after that, daily storage runs at the rate printed in the lot description.

05As-is sale

All lots sell as-is, where-is, with all faults. Photographs, descriptions and odometer readings are believed accurate but are general information only. We give no warranty — express, implied or statutory. Inspect anything you intend to bid on.

06Prohibited conduct

You must not:

  • Bid without the means to honour the bid;
  • Coordinate with other bidders to suppress bidding;
  • Run bots or scrapers against the Service without written consent;
  • Attempt to bypass authentication or rate limits;
  • Use the Service to launder funds or support illegal activity;
  • Misrepresent your identity, affiliation or jurisdiction.

07Limitation of liability

To the maximum extent the law allows, our total liability is limited to the greater of (a) what you paid us in the twelve months before the claim, or (b) one thousand US dollars. We are not liable for indirect, incidental, special, consequential or punitive damages.

08Disputes

These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-laws rules. Any dispute is resolved exclusively in the state or federal courts sitting in Indiana.

09Changes

We may update these Terms. Material changes are posted here with a new effective date and, where significant, sent by email. Continuing to use the Service means you accept them.
